CoStar Group Media Rights Terms and Conditions

CoStar Group has invested billions of dollars over several decades building CoStar Group’s digital products and marketplaces which are filled with proprietary content created by CoStar Group. Except as otherwise expressly set forth in an agreement between CoStar Group and a CoStar Group Customer, these CoStar Group Media Rights Terms and Conditions (“Media Terms”) reinforce and supplement all CoStar Group agreements that reference these Media Terms.

• Definitions.
  • CoStar Group, Inc. and its affiliates, including without limitation the brands listed here: https://www.costargroup.com/about-us/brands
  • CoStar Group Media: Photographs, imagery, videos, 3D tours, and any other media created or acquired by or on behalf of CoStar Group. For the avoidance of doubt, CoStar Group Media does not include media (including 3D tours) created pursuant to Matterport’s direct agreements with its customers, which is governed by the applicable direct Matterport agreement.
  • CoStar Group Customer: Any person who has a current agreement with CoStar Group for a CoStar Group product or service.
  • CoStar Watermark: The five map pins arranged to form a star in the center, regardless of color, displayed on CoStar Group Media: CoStar Group Media:  . This CoStar Watermark, when placed in CoStar Group Media in isolation (i.e. not next to a brand name such as “CoStar”, “Apartments.com”, “Homes.com”, “Matterport”, etc.) is an indication of CoStar Group’s copyright ownership.
• Ownership.
  • CoStar Group retains exclusive ownership and all proprietary rights to all CoStar Group Media.
  • CoStar Group Customers retain all existing ownership rights in any media they submit to CoStar Group through CoStar Group’s products and services.

• Permitted Uses for CoStar Group Media. . Each CoStar Group Customer has a license to use CoStar Group Media depicting each property owned, controlled, or represented by the CoStar Group Customer in connection with the marketing of the property, or the marketing of the CoStar Group Customer’s business, as set forth in the table below. Such license is limited and is not transferable or sublicensable, except as shown in the table below.

   

  

   

• Prohibited Uses.
  • CoStar Group Media may not be used or displayed on any third party platforms, websites, or listing services that compete with CoStar Group’s products and services (except, in the case of media permitted to be displayed on the multiple listing service under Section 3 above, to the extent syndicated by the applicable multiple listing service).
  • CoStar Group Media may not be altered or modified in any way, and all CoStar Group branding, watermarks (including the CoStar Watermark) and text, audio tracks and subtitles must be retained in their original form.
  • Any license to CoStar Group Media granted to a CoStar Group Customer ceases at the time such person is no longer a CoStar Group Customer, and any license to CoStar Group Media provided under a particular product, service, or subscription tier ceases at the time such person no longer maintains that product, service, or tier (except, in the case of media permitted to be displayed on the multiple listing service under Section 3 above, to the extent syndicated by the applicable multiple listing service).
